By accessing or using ARTHA ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including visitors, registered users, and subscribers.

Description of Service

ARTHA is an AI-powered financial terminal designed for Indian equity markets. The Service aggregates and presents market data from the National Stock Exchange (NSE), Bombay Stock Exchange (BSE), and other publicly available sources. Features include real-time and delayed market data, AI-driven stock analysis, technical charting, options chain analysis, stock screening, portfolio tracking, and related financial information tools. Features vary by subscription tier.

AI-Generated Analysis

ARTHA uses artificial intelligence and large language models to generate stock analysis, summaries, and insights. This AI-generated content is automated and is not personalized financial advice. AI outputs may contain errors, inaccuracies, or outdated information. AI analysis does not account for your individual financial situation, risk tolerance, or investment objectives. You should independently verify any AI-generated information before relying on it for any purpose.

Third-Party Data Sources

The Service displays market data sourced from third-party providers including, but not limited to, the National Stock Exchange of India (NSE), Bombay Stock Exchange (BSE), and Yahoo Finance. ARTHA does not endorse, warrant, or guarantee the accuracy, completeness, or timeliness of any third-party data.

Market data may be delayed, inaccurate, or incomplete. Real-time data availability depends on exchange feed status and may be subject to delays of 15 minutes or more.ARTHA is not responsible for any errors or omissions in data provided by third-party sources. Use of third-party data is subject to the respective terms and conditions of those data providers.

No Guarantee of Accuracy

While we strive to present accurate and up-to-date information, ARTHA makes no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, reliability, suitability, or availability of the data, analysis, or any other content provided through the Service. Any reliance you place on such information is strictly at your own risk.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms.

Subscription and Payments

ARTHA offers free and paid subscription tiers. Paid subscriptions are billed in Indian Rupees (INR) and processed through Razorpay. By subscribing, you authorize us to charge your selected payment method on a recurring basis at the interval you select (monthly or annual).

• You may cancel your subscription at any time from your account settings
• Access continues until the end of the current billing period after cancellation
• Refunds are provided on a case-by-case basis within 7 days of charge
• Prices are subject to change with 30 days' prior notice via email
• All applicable taxes, including GST, will be added to the subscription price

Assumption of Risk

Trading and investing in securities involves substantial risk of loss and is not suitable for every person. By using the Service, you acknowledge and agree that:

• You assume all risk associated with your investment decisions
• ARTHA shall not be held liable for any investment losses you incur
• Market conditions can change rapidly and unpredictably
• Historical data and backtested results are not indicative of future performance
• You will not hold ARTHA responsible for any trading or investment outcomes

Intellectual Property

All content, features, and functionality of the Service -- including but not limited to text, graphics, logos, software, and AI models -- are the exclusive property of ARTHAand are protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

Limitation of Liability

To the maximum extent permitted by applicable law, ARTHA, its founders, directors, employees, affiliates, and partners shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or investment losses arising from:

• Your use of or inability to use the Service
• Any errors, inaccuracies, or omissions in market data or AI-generated analysis
• Any investment decisions made based on information obtained from the Service
• Unauthorized access to or alteration of your data
• Any interruption or cessation of the Service

Our total aggregate liability for all claims arising out of or relating to these terms or the Service shall not exceed the total amount you paid to ARTHA in the 12 months preceding the event giving rise to the claim, or INR 5,000, whichever is greater.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these terms, is harmful to other users or the Service, or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may export your data before termination by contacting support.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes, claims, or controversies arising out of or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice on the Service at least 30 days before they take effect. Your continued use of the Service after changes constitutes acceptance of the modified terms. If you do not agree to the updated terms, you must stop using the Service.
